1. Acceptance of these Terms
By creating an account, using the website or portal, requesting a hosting position, purchasing goods or services, or otherwise using our services, you agree to these Terms and any order, hosting agreement, pricing disclosure, or policy presented to you for the applicable service. If a separate signed or accepted hosting agreement conflicts with these Terms, the hosting agreement controls for that hosting service.
2. Eligibility and accounts
You must provide accurate account and contact information and keep your login credentials secure. You are responsible for activity performed through your account. You may not use another person's account without authorization or interfere with the security or operation of the service.
3. Hosting services
Hosting availability is subject to facility capacity, electrical requirements, airflow, equipment compatibility, safety review, and operational approval. A requested position is not guaranteed until approved. Hardware arrival, setup, activation, metering, monitoring, cancellation, release, and other operational requirements may be governed by the hosting agreement and the terms displayed during the reservation process.
4. Fees, invoices, and payments
Prices, deposits, setup fees, hosting charges, electricity rates, merchandise charges, shipping, and other amounts are shown in the applicable quote, checkout, invoice, or agreement. Payments may be processed by third-party providers such as Intuit QuickBooks and PayPal. Their terms and privacy practices also apply to information processed by them. Refunds, credits, and cancellations are handled according to the applicable order or hosting agreement and applicable law.
5. Hardware, telemetry, and monitoring
Where applicable, you authorize us to identify, configure, monitor, and operate hosted mining hardware as reasonably necessary to provide the hosting service. This may include device identifiers, MAC addresses, serial numbers, pool or worker information, temperatures, hashrate, uptime, power-related data, and operational events. Monitoring information is provided for operational visibility and may not be continuous or error-free.
6. Customer portal license
Subject to these Terms, Bee's Knees grants you a limited, revocable, non-exclusive, non-transferable license to access and use the customer portal and related software solely for your own authorized business or personal use with Bee's Knees services. You may not copy, resell, reverse engineer, circumvent access controls, scrape protected areas, introduce malicious code, or use the portal to interfere with our systems or another user's account.
7. Acceptable use
You may not use our services for unlawful activity, fraud, abuse, unauthorized access, infringement, harassment, or activity that could damage our systems, facilities, network, service providers, or other customers. We may suspend access when reasonably necessary to protect safety, security, legal compliance, or service integrity.
8. Third-party services
Our services may integrate with third parties, including identity, hosting, database, accounting, payment, mining-management, and network providers. We are not responsible for third-party services outside our control, and their availability, terms, and policies may change independently of Bee's Knees.
9. Intellectual property
The Bee's Knees Mining name, branding, website, portal, software, designs, text, graphics, and related materials are owned by Bee's Knees Mining LLC or its licensors and are protected by applicable intellectual-property laws. No rights are granted except the limited use rights expressly stated in these Terms.
10. Service availability and disclaimers
Mining performance, network difficulty, token or coin value, profitability, pool performance, internet connectivity, and third-party platform availability are outside our control. We do not guarantee mining profitability, uninterrupted operation, or any particular financial result. Except as required by law or an applicable written agreement, services are provided on an "as available" basis.
11. Limitation of liability
To the maximum extent permitted by law, Bee's Knees Mining LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, lost mining rewards, lost data, or losses caused by third-party networks or services. Any limitation or allocation of risk in a separately accepted hosting agreement also applies to the covered service.
12. Suspension and termination
You may stop using the website or portal at any time, subject to outstanding obligations under active orders or hosting agreements. We may suspend or terminate access for material breach, nonpayment, fraud, security risk, unlawful conduct, or as otherwise permitted by an applicable agreement or law.
13. Changes
We may update these Terms from time to time. The effective date at the top of this page identifies the current version. Material changes may be communicated through the website, portal, or other reasonable means.
14. Governing law
Unless a separate agreement states otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, and subject to applicable federal law.
